TERMS & CONDITIONS :-
01. All bills are to be submitted on delivery and the company has the right to charge penalty/cancel for late shipments. All Payment will be made through
Bank.
02. It is the condition of the contract in addition to other conditions, warranty implied by the law that the said goods shall confirm to the description
specification
and quality here in provided that merchantable workmanship as per the agreed quality standards.
03. The Company will not be liable in respect of any order not given or confirmed on its official order assigned by the authorized representative of the
company.
04. The parties here by agree that any suit to enforce the right of either party under this order shall only instituted in andtried by the courts of ordinary
jurisdiction in the city of Bangalore, India.
05. TDS As Applicable.
06. You have been selected for supply of Goods by Buyer and henceforth you will be termed as "Nominated Supplier"
07. The terms of this order shall be back to back as "Texport/ND" has with the buyer.
08. In the case of cancellation of the order by the buyer, your order shall also be cancelled and compensation shall be back to back.
09. We shall make payment for the supplies upon receipt of payment from our buyer.
10. In the event of delay in deliveries to the buyer on account of delay in supplies by you, we shall be entitled to set of the damages against monies due
to you for the subject supplies.
11. You shall confirm that the supplies are in conformity with the quality and terms set by the buyer.
12. In the case of any quality issues raised by buyer in later stage with respect to faulty supplied goods by you and damages claimed from us then
same shall be reimbursed from you .
13. On quality matters the buyers decision will be final and binding.
